These Terms of Service govern your use of the Smoke Tracker mobile application by AY Tech Systems and related services.

1. Acceptance of Terms

By downloading, installing, or using the Smoke Tracker app (package ID: com.mysmoketracker.app), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

2. Description of Service

Smoke Tracker is a mobile application by AY Tech Systems designed to help users privately track their smoking and vaping habits using local device storage. The app provides:

• Local cigarette and vape session logging using SQLite database
• Private statistical analysis of smoking patterns (processed on-device)
• Trigger identification and insights (stress, social, boredom, habit, craving)
• Progress monitoring tools with visual charts
• Health timeline milestones (based on general medical research)
• Guided breathing exercises for craving management
• Data export capabilities (CSV format for personal use)
• Premium features including advanced analytics and custom themes

3. Eligibility

You must be at least 18 years old to use Smoke Tracker. By using the app, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.

The app is not intended for use by minors under 18 years of age.

• The app does not provide medical advice, diagnosis, or treatment
• Always consult healthcare professionals for medical concerns
• Do not use the app as a substitute for professional medical care
• If you're experiencing health issues related to smoking, seek medical attention
• Health timeline milestones are based on general research and may not apply to all individuals

5. User Responsibilities

5.1 Accurate Information

You are responsible for providing accurate information when using the app. While the app can provide insights based on the data you enter, the quality of insights depends on the accuracy of your inputs.

5.2 Device Security and Data Protection

Since all your smoking data is stored locally in an SQLite database on your device, you are responsible for:

• Keeping your device secure with appropriate locks (PIN, password, biometric)
• Understanding that your data security depends on your device's security
• Regularly exporting your data as backup if desired (available in app settings)
• Understanding that lost, stolen, or damaged devices will result in data loss
• Not sharing your device with others if you want to keep your data private

5.3 Appropriate Use

You agree to use the app only for its intended purpose and not to:

• Attempt to reverse engineer or modify the app
• Use the app for any illegal or unauthorized purposes
• Share your app access with others
• Attempt to extract or access others' data
• Interfere with the app's functionality or security

6. Privacy and Data

Privacy is fundamental to how Smoke Tracker works. Our Privacy Policy, which is incorporated into these terms by reference, explains our local-first approach. Key points:

• All smoking data stored locally: SQLite database on your device only
• No cloud sync or uploads: Your data never leaves your device
• No data collection: We cannot see, access, or analyze your smoking patterns
• Complete ownership: You own and control 100% of your data
• Export anytime: CSV export available for backup or sharing with healthcare providers
• Delete anytime: Clear all data or specific entries as desired

7. Premium Features and Subscriptions

7.1 Free Features

Core features are 100% free forever and include:

• Daily cigarette and vape tracking
• Trigger identification
• Basic statistics and progress charts
• Health timeline milestones
• Guided breathing exercises
• Achievement system
• Data export (CSV)

7.2 Premium Features

Premium features available through subscription include:

• Advanced analytics with custom date ranges
• Detailed trigger analysis and insights
• Beautiful app themes (Ocean, Forest, Sunset, Lavender)
• Enhanced data export options
• Custom reminder schedules
• Priority customer support

Note: All premium features maintain complete privacy - no data is ever uploaded to servers.

7.3 Subscription Terms

7.4 Free Trial

If a free trial is offered:

• The trial period is 6 days for new users
• You can cancel during the trial to avoid charges
• The subscription begins automatically after the trial ends
• Only one trial per Google Play account
• Trial terms may change with notice

7.5 Billing and Payment

Subscription Billing:

• Subscriptions are billed through Google Play Store
• Auto-renewal occurs 24 hours before the current period ends
• Prices are subject to change with 30 days' notice
• Billing is managed by Google Play - we don't process payments directly
• You can manage subscriptions in Google Play Store settings

7.6 Cancellation

To cancel your subscription:

1. Open Google Play Store app on your device
2. Go to Menu → Subscriptions
3. Select "Smoke Tracker"
4. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You'll retain premium access until then. After cancellation, you'll revert to free features.

Promotional prices are for new subscribers only. If you cancel and resubscribe, standard pricing applies unless another promotion is active.

8. Intellectual Property

The Smoke Tracker app, including its design, code, features, and content, is owned by AY Tech Systems and protected by intellectual property laws. You are granted a limited license to use the app for personal purposes only.

You may not:

• Copy, modify, or distribute the app
• Reverse engineer or decompile the app
• Remove copyright or proprietary notices
• Use the app's name, logo, or branding without permission

9. Disclaimers

9.1 No Health Claims

We make no claims that using Smoke Tracker will help you quit smoking or vaping or improve your health. The app is a tracking tool only. Results vary by individual.

9.2 App Availability

While we strive to keep the app available and functional:

• We cannot guarantee 100% uptime or availability
• The app may be unavailable during maintenance
• Features may change or be discontinued with notice
• We may stop supporting older devices or operating systems
• App performance depends on your device and network

9.3 Third-Party Services

The app integrates with third-party services (RevenueCat, Firebase, Google Play). We are not responsible for their availability, performance, or privacy practices.

10. Limitation of Liability

To the maximum extent permitted by law, AY Tech Systems shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data due to device issues or user error
• Any health-related outcomes or decisions based on app data
• Technical issues with your device or operating system
• Interruptions or errors in app functionality
• Unauthorized access to your device or data
• Damages exceeding the amount you paid for the app (if any)

11. Indemnification

You agree to indemnify and hold harmless AY Tech Systems from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Any health-related decisions made based on app data
• Your failure to secure your device

12. Changes to Service

We reserve the right to:

• Modify or discontinue the app or any features
• Update these terms of service
• Change subscription pricing with 30 days' notice
• Add or remove features from the app
• Discontinue support for certain devices or OS versions

12.1 Notice of Changes

We will notify users of material changes through:

• In-app notifications
• Updates to our website
• Email notifications (if you've provided an email)

Continued use of the app after changes constitutes acceptance of the new terms.

13. Termination

You may stop using the app at any time by deleting it from your device. We may terminate or suspend access to the app if you violate these terms.

Upon termination:

• Your right to use the app immediately ceases
• You should delete the app from your device
• Local data will remain on your device until you delete it
• Premium subscriptions will be handled according to cancellation terms

14. Google Play Store Policies

By downloading Smoke Tracker from Google Play Store, you also agree to:

If there's a conflict between these Terms and Google Play's policies, Google Play's terms control regarding app distribution and payments.

16.1 Informal Resolution

16.2 Arbitration Agreement (U.S. Users)

For U.S. users, any disputes will be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action or representative proceeding.

16.3 European Users

European users may also file complaints with their local data protection authority or consumer protection agency.

17. Export Compliance

You agree not to export or re-export the app to any country or person prohibited by U.S. export control laws and regulations.

The app is available in multiple countries, but:

• Some features may not be available in all regions
• You are responsible for compliance with local laws
• These terms are governed by the laws where our company is located
• Pricing may vary by region

19. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and AY Tech Systems regarding the use of Smoke Tracker.
